Shand Morahan & Company (Evanston) has made changes to their Specified Medical policy form. Highlights follow:
Expands THE INSURED coverage to include:
Coverage for medical director for
administrative acts.
Coverage for students for risks with
training programs.
Affirms volunteer worker coverage and
defines who is a volunteer worker.
Replaces “Optional Extended Reporting Period: with the standard industry terminology, “Extended Reporting Period.”
Defines coverage for professional services as the “Professional Services” described on the Declarations.
Expands “Definitions” in a newly created “Definitions” section.
Affirms “pure” claims made (not “claims made and reported”).
Expands exclusions to include RICO and ERISA (which are usual and customary exclusions in the marketplace today) and the exclusion for “guarantee of cure/treatment success.”
“Sexual Acts” exclusion modified. No longer an absolute exclusion. Now, provides “Named Insured” defense for vicarious liability of “Named Insured” unless there was prior knowledge.
Adds “Premium and Audit” section under OTHER CONDITIONS that addresses “Insured’s” and “Company’s” rights when a premium is auditable.
“Punitive Damages” exclusion has moved from the EXCLUSION section. Look for “Punitive Damages” to be addressed in the definition of “Damages” in the new DEFINITION section.
